In a complex environment, partial solutions are not enough

The disadvantages of a technical partial solution for age verification are usually obvious. The greatest potential for problems arises when linking age verification to an email address and password. The Commission for Youth Media Protection (KjM) rightly emphasizes that this process is not suitable for repeated media use. If an account is checked and activated, the user can easily pass on the access data to other people. Misuse can hardly be avoided in this way. Such a partial solution therefore does not meet the requirements of the KjM guidelines.

Requirements for a complete solution

The State Treaty on the Protection of Minors in the Media and the Commission for the Protection of Minors in the Media place clear demands on an overall technological solution. The AVS must carry out an age check for closed user groups in two consecutive steps.

Step #1: One-time identification and age verification through a personal contact (or other approved method).

Step No. 2: Authentication of the user during each usage process to exclude the transfer of data to minors.

These two processes underline the fact that a single user identification is not sufficient for the repeated use of offers. Because emails and passwords can be easily shared with others. Such a partial solution is not up-to-date and does not comply with the KjM specifications.

Regulatory environment: signs point to tightening

In Germany, the Commission for Youth Media Protection (KJM) tasked with regulating the identity verification process. The KJM is therefore responsible for compliance with the State Treaty on the Protection of Minors in the Media and defines the necessary requirements.

Legal situation: what’s coming? What remains? What's up?

In order to protect minors and make virtual rooms safe, new measures have been introduced over the last few years. The State Treaty on Gambling and the licensing requirements for streamers are just some of the most prominent examples of this.

But time does not stand still at the European level either. The EU Directive for Audiovisual Media Services (AVMS) regulates the coordination of media formats: from classic television to on-demand offers. The EU legal framework follows the German model for a safe and diverse audiovisual media landscape. The German approach requires an age check to be carried out every time you interact with a media platform. The strictest measures apply to the adult industry. In this context, supervisory authorities impose particularly high fines. Even the slightest missteps can lead to the closure of an entire platform (Protection of minors on the Internet).
